Welcome to Vardaan ("Platform," "we," "our," or "us"). These Terms of Service ("Terms") govern your use of our mobile apps, web portals, IoT integrations, and related services. By accessing or using the Platform, you agree to these Terms. If you do not agree, please discontinue use immediately.
1. Purpose of the Platform
Vardaan provides safety, health monitoring, smart home integration, and communication tools for:
- Elders (direct B2C users)
- Residents (elders enrolled via elder care homes)
- Family Members & Guardians
- Caregivers, Doctors, and Healthcare Providers
- Elder Care Home Staff & Administrators
⚠️ The Platform is a support tool only. It is not a substitute for professional medical care, diagnosis, or treatment. Always seek medical advice when required.
2. Eligibility
- Elders (B2C): Individuals aged 55+ or their authorized guardians.
- Residents (B2B): Elders registered through elder care homes.
- Family/Guardians: Adults with elder/resident consent.
- Caregivers & Healthcare Providers: Verified professionals.
- Elder Care Homes (B2B): Institutions enrolling residents and assigning staff.
3. Role-Specific Terms
3.1 Elders (Direct Users)
- Must provide accurate health and personal information.
- Consent to share data with family/guardians and chosen caregivers.
- Acknowledge alerts/reminders are supportive, not guaranteed.
3.2 Residents (Elders in Care Homes)
- Registered and managed by care homes.
- Health and emergency data may be shared with staff, doctors, and authorized family.
- Retain rights to access, correction, and deletion (subject to regulatory requirements).
3.3 Family Members & Guardians
- Access limited to elders’/residents’ data with consent.
- Must respond promptly to alerts when designated.
- May act as emergency contacts or nominated representatives.
3.4 Caregivers & Healthcare Providers
- Must comply with professional and ethical standards.
- Responsible for accuracy of records, prescriptions, or notes entered.
- Prohibited from using Platform data for unrelated or personal purposes.
3.5 Elder Care Home Staff & Administrators
- Manage resident onboarding, vitals tracking, incident reporting, and shifts.
- Must maintain confidentiality and comply with elder care regulations.
- Institution is accountable for staff conduct and accuracy of records.
3.6 Platform Administrators (Vardaan)
- Provide secure, compliant, and reliable services.
- Manage subscriptions, billing, and technical support.
- Deliver AI-driven insights, which are informational only.
4. Acceptable Use
You agree not to:
- Use the Platform for unlawful/fraudulent purposes.
- Tamper with devices, sensors, or integrations.
- Share login credentials or impersonate another user.
- Upload malicious software or attempt to breach security.
5. Subscriptions & Payments
- Some features are free; others require paid subscription.
- Pricing, renewals, and refunds are disclosed before purchase.
- Care homes may have enterprise billing agreements.
- Refunds/cancellations follow Vardaan’s policy.
6. Privacy & Data Protection
6.1 Data We Collect
- Personal Data: Name, age, gender, contact details, emergency contacts.
- Health Data: Vitals (heart rate, BP, glucose, oxygen, etc.), activity, medication, mood logs.
- Resident Data (B2B): Profiles, staff notes, shift records, incidents.
- Device Data: IoT readings, smart home status, usage logs.
- Emergency Data: Location (GPS), SOS events.
6.2 How We Use Data
- Deliver monitoring, alerts, and emergency support.
- Enable dashboards for family, caregivers, and care homes.
- Provide AI-based health insights and predictions.
- Facilitate marketplace services (insurance, pharmacy, devices).
- Improve services through anonymized analytics.
6.3 Sharing of Data
- Authorized family & guardians (with consent).
- Caregivers & healthcare providers (when enrolled).
- Elder care home staff & doctors (for Residents).
- Emergency responders (ambulance, 911, local services).
- Third-party providers (insurance, pharmacies, IoT vendors) only as needed.

6.4 Your Rights
- Access, correct, or delete your data.
- Withdraw consent at any time (may limit services).
- Nominate a representative to exercise rights if incapacitated.
- Request a copy of your stored data (subject to verification).
6.5 Data Retention
- Data is kept as long as your account or contract is active.
- Certain records (e.g., incidents, compliance logs) may be retained for legal obligations.
6.6 Security
- Encryption in transit (TLS 1.3) and at rest (AES-256).
- Role-based access control, audit logs, and biometric/PIN login options.
- Regular security testing and monitoring.
6.7 Compliance
We comply with:
- GDPR (Europe): Right of access, correction, erasure, portability.
- HIPAA (U.S.): Safeguards for Protected Health Information.
- DPDP Act (India): Rights to correction, erasure, and nomination.
- Other local data laws where applicable.
7. Alerts & Notifications
- Alerts are based on device readings or AI analysis.
- False positives/negatives may occur; do not rely solely on the Platform.
- Keep emergency contact details updated.
8. Limitations of Liability
- Vardaan is not a substitute for medical care.
- We are not liable for missed alerts, device errors, or connectivity issues.
- Care homes remain responsible for resident care, staff actions, and compliance.
9. Termination
We may suspend/terminate accounts if you:
- Violate these Terms,
- Misuse the Platform, or
- Compromise safety/system integrity.
10. Intellectual Property
All Platform content, logos, and technology are owned by Vardaan. You may not copy, resell, or distribute without written permission.
11. Governing Law
These Terms are governed by the laws of [Insert Jurisdiction]. Disputes shall be resolved by [Insert Court/Arbitration Body].
12. Changes
We may update these Terms periodically. Significant updates will be notified via app/email. Continued use means acceptance.
